Acceptable Use and Copyright Policy

This policy sets out the content and conduct rules that apply when you use Custombull, and explains how copyright and trademark owners can notify us. It forms part of the [Terms of Service](/en/terms).

In short

  • Only upload and print designs you own or are licensed to use. Content that infringes anyone's copyright, trademark, privacy or publicity rights is prohibited.
  • We have zero tolerance for child sexual abuse material; the account is closed immediately and the matter is reported to the authorities.
  • Send marketing messages only to people who have consented. Purchased lists and messaging people who unsubscribed are prohibited.
  • Our copyright check is a helper tool, not a legal guarantee. You remain responsible for the lawfulness of your content.
  • Rights holders can send DMCA notices and sellers can respond with counter notices. Three valid strikes within 12 months lead to account termination.
  • We explain every enforcement decision and give you a way to appeal.

1. Scope

This policy applies to every user of the Custombull service operated by AKIN INDUSTRIES LLC, including the dashboard, API connections, Chrome extension, order tracking pages, Marketing Center and all related tools. The account holder is also responsible for the compliance of the sub users they invite.

Custombull is not itself a manufacturer. Orders are printed by independent contracted producers in the United States. This policy covers print jobs sent to those producers and listings you publish on marketplaces you connect.

The policies of the marketplaces you connect (Etsy, Shopify, eBay, Amazon and others) also bind you directly. Where a marketplace rule is stricter than this policy, you must follow that rule.

2. Prohibited content

You may not upload, generate, print, list or send through the service any content that:

  • Infringes anyone's copyright, trademark, or privacy or publicity rights (a person's name, likeness, voice or signature).
  • Is a counterfeit or brand imitation: products that use a brand's logo, packaging or distinctive elements in a way likely to mislead consumers.
  • Uses cartoon or game characters, film or TV imagery, sports team and league logos, university marks, or photos or drawings of celebrities without a license.
  • Contains hate speech based on race, ethnicity, religion, sex, sexual orientation, disability or other protected characteristics, or incites or glorifies violence, terrorism or self harm.
  • Harasses, threatens or defames a specific person or exposes their personal information.
  • Depicts child sexual abuse or sexualizes minors in any way. We apply zero tolerance: the content is removed immediately, the account is closed, and the matter is reported to the National Center for Missing & Exploited Children (NCMEC) and relevant authorities.
  • Is obscene, or is adult content that breaches the rules of the marketplace where you publish it.
  • Makes misleading health or safety claims, such as claims to prevent or cure disease, or otherwise deceives consumers.
  • Promotes or relates to illegal products or services whose sale, transport or promotion is prohibited.
  • Involves trade with persons, entities or countries on sanctions lists, including those maintained by the U.S. Treasury's OFAC.

3. Prohibited conduct

Service security

  • Attempting to disrupt or overload the service, bypass security controls or probe for vulnerabilities (for responsible disclosure, contact us first).
  • Reverse engineering the software, attempting to extract source code, or gaming rate limits, daily limits or credit quotas.
  • Accessing accounts, shops or data that are not yours, or using someone else's credentials.
  • Automated access, scraping or bulk data extraction outside the interfaces we provide, without our written permission.

Marketplaces and buyers

  • Flooding a marketplace with spam listings, bulk publishing listings you have not reviewed, or bulk listing in ways that breach the marketplace's policies.
  • Fake reviews, fake orders, artificial sales or ranking manipulation.
  • Using buyer data for anything other than fulfilling the order, in particular for unsolicited marketing.

Marketing messages

Through the Marketing Center (email, SMS, WhatsApp) you may message only people who have given legally valid consent. In particular:

  • In the United States you must comply with the CAN-SPAM Act (accurate sender information, non misleading subject lines, a physical postal address, a working unsubscribe link) and, for text messages, the TCPA (prior express written consent for marketing texts, STOP opt out, sending hours).
  • For people in the EU and the UK, comply with the GDPR and ePrivacy rules; for Canada, comply with CASL.
  • Before sending commercial electronic messages to people in Türkiye, obtain consent under Law No. 6563 and its regulation, register with the Message Management System (İYS) where required, and comply with the KVKK.
  • Using purchased, rented or scraped lists is prohibited.
  • Messaging people who have unsubscribed or objected is prohibited. Do not attempt to bypass the suppression list the system maintains.

AI and real people

  • Using AI output to create misleading product descriptions, fake customer reviews or false documents.
  • Generating or printing a realistic image, voice or deepfake of a real person without that person's permission.

4. AI usage rules

Custombull uses third party AI model providers to generate ideas, designs, mockups, titles, tags, descriptions and message reply suggestions. When you use these features:

  • In addition to this policy, you must comply with the usage policies of the relevant AI provider. Requests the provider rejects may also be rejected by our system.
  • AI output is a suggestion. It is not sent to a marketplace without your approval; if you choose the "auto publish" setting in Automatic Production, you give that approval in advance.
  • AI output may resemble existing works, trademarks or characters. Checking it and changing it where needed before publishing is your responsibility.
  • Do not try to produce imitations by entering another party's brand, character or celebrity name in your prompts.

6. Enforcement

Where we reasonably believe this policy has been breached, we may take one or more of the following steps depending on the severity:

We generally act in stages. However, for child sexual abuse material, counterfeit trade, sanctions violations, fraud, or conduct that endangers the security of the platform or a marketplace connection, we may act immediately without prior warning.

Unless legally prohibited, we notify you of each action and the reasons for it by email or in the dashboard.

7. Reporting violations

If you believe content on the service breaches this policy, email hello@custombull.com with a link to the content or the order or listing details, and the reason. Copyright and trademark complaints follow the specific procedures below.

8. Copyright notices (DMCA)

Under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512), if you believe your copyright is being infringed on our service, your written notice must include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to be infringed (or a representative list if several works are involved).
  3. Identification of the material claimed to be infringing and information reasonably sufficient for us to locate it (listing link, order number, image).
  4. Your contact information: name, postal address, telephone number and email.
  5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

When we receive a complete notice, we expeditiously remove or disable access to the material, stop it from being sent to print, and notify the user who uploaded it with a copy of the notice. We may ask you to complete an incomplete notice.

Anyone who knowingly materially misrepresents that material is infringing may be liable for damages, including attorneys' fees, under 17 U.S.C. § 512(f). Please consider whether the use may be fair use before sending a notice.

9. Counter notices

If you believe your content was removed by mistake or misidentification, you may send a counter notice to the address above containing:

  1. Your physical or electronic signature.
  2. Identification of the material removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address and telephone number.
  5. A statement that you consent to the jurisdiction of the U.S. federal district court for the judicial district in which your address is located or, if your address is outside the United States, the federal court for the Southern District of Texas (Houston), where the service provider is located, and that you will accept service of process from the person who provided the original notice or their agent.

We forward a valid counter notice to the person who sent the original notice. Unless that person informs us, within 10 business days after we receive the counter notice, that they have filed an action seeking a court order to restrain the use, we restore the material or access to it within 10 to 14 business days.

Anyone who knowingly materially misrepresents facts in a counter notice may also be liable under § 512(f).

10. Repeat infringer policy

In appropriate circumstances we terminate the accounts of repeat infringers. Under this policy:

  • Each valid copyright or trademark notice that has not been withdrawn or successfully countered counts as a strike.
  • Three valid strikes within 12 months lead to termination of the account.
  • We may terminate earlier depending on severity, intent, counterfeit character, or where many works are affected at once.
  • The holder of a terminated account may not circumvent this policy by opening a new account.

11. Trademark and other rights complaints

Send trademark, privacy or publicity rights complaints to hello@custombull.com with the subject "Rights complaint". Include the rights holder's identity, registration details (registration number and country, if any), the location of the allegedly infringing content and a good faith statement. We review the complaint, ask the uploading user for their position where appropriate, and inform both parties of our decision.

12. Complaints from outside the United States

Individuals and entities in the European Union may notify us of illegal content in line with the notice and action principles of the EU Digital Services Act (DSA). A notice should include the reasons, the exact location of the content, the notifier's name and email, and a good faith statement.

  • We review notices diligently, objectively and within a reasonable time.
  • We give a statement of reasons, with the facts and rules relied on, to both the notifier and the uploader.
  • An internal complaint (appeal) is available at hello@custombull.com. Appeals are reviewed by someone other than the person who made the original decision.
  • This route does not affect your right to go to the competent courts or authorities.

We review complaints from Türkiye and other countries on the same principles, taking into account mandatory local law.

13. Notices from marketplaces

If a marketplace (for example Etsy, eBay, Shopify or Amazon) removes one of your listings for infringement or a policy breach, warns your shop, or forwards a notice to us:

  • We may pause pending print jobs for the affected product and let you know.
  • We may block the same design from being transferred or republished to your other connected channels.
  • Marketplace appeals are governed by that marketplace's own rules. You need to file the appeal; on request we share the records we hold.
  • Consequences of a marketplace suspending your account or removing listings are governed by the Terms of Service.

14. Your right to appeal

You may appeal any decision taken against you under this policy within 30 days of being notified, by emailing hello@custombull.com with the subject "Appeal", your reasons and any supporting documents. We review appeals within a reasonable time and give reasons for the outcome. If your appeal succeeds, we lift the measure and, where relevant, restore the content and access.

15. Changes

We may update this policy to reflect legal requirements, marketplace rules or changes to the service. We give at least 30 days' notice of material changes by email or in the dashboard before they take effect; urgent measures against illegal content are not subject to this notice period.
